Terms of Service

1. Acceptance

By creating a DASH Memories account, uploading content, or purchasing a memorial product from us, you agree to these Terms. If you do not agree, do not use the service.

2. Your Content; License to DASH

You retain ownership of every photo, video, audio file, name, date, and message you upload (“Your Content”). You grant DASH Memories Inc. a non-exclusive, worldwide, royalty-free license to host, store, transcode, display, and transmit Your Content for the sole purpose of operating the service — specifically, rendering the memorial you or your designee created, fulfilling print orders, and delivering the QR-linked tribute to visitors. This license terminates when you delete the memorial (subject to reasonable technical caching).

3. Your Warranties

You represent and warrant that (a) you own Your Content or have obtained all necessary permissions from the rightsholders (for photos of the deceased, music tracks, embedded YouTube videos, etc.); (b) Your Content does not violate any third-party copyright, trademark, right of publicity, or privacy right; and (c) you have authority from the family of the deceased to create and publish the memorial.

4. Acceptable Use

You agree not to:

  • Upload content you do not have the right to share.
  • Impersonate another person, including the deceased's family.
  • Use the service to harass, defame, or distribute unlawful content.
  • Probe, scan, or attempt to bypass the platform's security.

5. Copyright Takedowns (DMCA)

DASH Memories complies with the Digital Millennium Copyright Act. If you believe content on the service infringes your copyright, see our DMCA Procedure for how to submit a takedown notice.

6. Repeat-Infringer Policy

In appropriate circumstances and at our sole discretion, we will terminate the accounts of users who are repeat copyright infringers, as required by 17 U.S.C. § 512(i).

7. Service Availability

We do not guarantee uninterrupted access. The service is provided “as is” without warranties of any kind. We may modify, suspend, or discontinue features at any time.

8. Limitation of Liability

To the maximum extent permitted by law, DASH Memories Inc., its officers, directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the service. Our aggregate liability for any direct damages is limited to the amount you paid us in the 12 months preceding the claim.

9. SMS / Text Messaging Program

DASH Memories sends one-time verification codes (two-factor authentication) by SMS. You opt in by entering your mobile number on our sign-up or sign-in screen and tapping “Send code.” You will receive a message only when you request a code; message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle mobile information — we do not share or sell your mobile opt-in data to third parties for marketing.

10. Refunds

Memorial product orders are custom-printed. Refunds are evaluated case-by-case. Contact support@dashmemories.com.

11. Changes to These Terms

We may update these Terms. Material changes will be flagged on this page; continued use after a change constitutes acceptance.
